TERMS and CONDITIONS TERMS AND CONDITIONS: The Service: • JDF Enterprises provides Web Solutions, Computer and Network Services and internet server space for clients with a fee in the express purpose of providing http content to the general public. In addition to this our members may also received internet mail after taking the steps to set-up the mail boxes and forwarding accounts. • Customers are permitted to make necessary changes in their website. They may contact JDF Enterprises to upload files for their websites. In addition to this, we may, offer services that relate to the selling for internet server space. These bonus services may change from time to time. • JDF Enterprises agrees to provide customer support within the duration of the availed package. Either through phone, internet chat or email support (provided by client) • Customer is responsible for and must provide all telephone and other equipment and services necessary in order for JDF Enterprises to maintain customer’s account remotely through FTP accounts. • Customer agrees that he/she is at least 18 years of age. If the customer is not 18 years of age, a parent or guardian’s name must be put on the account and will be responsible for timely payments and contents of the website. If a minor obtains an account through JDF Enterprises, without parental or guardian’s approval and signature, this agreement becomes NULL & VOID. • JDF Enterprises’ product and service as a whole package is provided “as is”. All information and data is provided within the website JDF Enterprises and the company sales kit. • The customer freely agrees that the use of JDF Enterprises is at customer’s SOLE RISK. Neither JDF Enterprises nor any of its information providers, licensers,employers or agents warrant that the service will be UNINTERRUPTED or ERROR FREE, nor does WebCORE.Net Inc nor any of its information providers, licensers, employers or agents make any warranty as to the results to be obtained from the use of the service. The service is distributed on an “AS IS” BASIS without warranties of any kind, whether expressed or implied. Including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular pupose. Other than those warranties, which are implied by and incapable of exclusion, RESTRICTION or MODIFICATION under the laws applicable to this Service Agreement, neither JDF Enterprises nor the anyone else involved in creating, producing or deliveringthe service shall be liable for any DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES arising from the USE OF THE SERVICE or the INABILITY TO USE THE SERVICE. Or out of any breach of any warrant. CUSTOMER EXPRESSLY ACKNOWLEGES THAT THE PROVISION OF THIS PARAGRAPH SHALL ALSO APPLY TO ALL THIRD PARTY CONTENT AND ANY OTHER CONTENT AVAILABLE THROUGH THE SERVICE. • JDF Enterprises strictly prohibits email harassment whether through language, frequency, or size of messages. Forging or header information is not permitted. • Copyrighted materials must not be placed on Customer’s account without the permission or unless authorized by the owner(s) or person(s). Only the owner(s) or such authorized person(s) may upload copyrighted materials to the account. • Any customer in violation of system or network security is subject to criminal and civil liability as well as immediate account termination. Example include but are not limited to the following: Unauthorized access, use, probe, scan of a system security or authentication measures, data or traffic, interference with service to any user, host or network including, without limitation, email bombing. Flooding, deliberate attempts to overload a system and broadcast attacks.. Forging of any TCP/IP packet header or any part of the header information in an e-mail or news group posting. • Customer agrees not to publish on or over its account any information, software or any other content which violates or infringes upon the rights of any other party or which knowingly contravenes the laws of any jurisdiction in which such content is generally accessible. • Any use of JDF Enterprises systems that disrupts the normal use of the system for other JDF Enterprises customers is considered to be ABUSE of JDF Enterprises services and is grounded for termination in this Service Agreement. Some examples of abuse include (but not limited to) spawning dozens of processes, consuming large amount of memory, or CPU cycles for long periods of time attempting to access other customer’s account areas or conducting provocative activities such as mass emailing (spam) which may result in retaliatory actions against JDF Enterprises ‘ systems. • Depending upon the nature and severity of any abuse, the customer will receive an email warning detailing the nature of abuse. If the service is not terminated within one (1) day, a final email will be sent to the customer formally requesting termination or removal of the stated abuse. Customer must then terminate/remove that stated abusive element within the day, otherwise the Service Agreement will be terminated immediately. Any reconnection of a terminated account will require a reconnection fee and more strict review of materials prior to reconnection. • If, in JDF Enterprises sole discretion, the nature and severity of any abuse is severe enough, JDF Enterprises may terminate the Service Agreement immediately without written notification prior to termination. This will be subject to reconnection fee, however, JDF Enterprises reserves the right to deny all future access upon termination. • JDF Enterprises has the right to de-activate accounts if payments are not received in a timely manner. The customer agrees to hold JDF Enterprises FREE and HARMLESS form any and all claims, demands, causes of action, obligations, damages, or liabilities including court cost and attorneys fees, that may be filed against JDF Enterprises in connection with JDF Enterprises exercise of such right.
